The hearing was called to order at 8:15 p.m.

#1554              Pine Woods Development, LLC                  Norwood Street

Applicant seeks zoning regulation exemptions to locate a 104 unit development under M.G.L., Ch. 40B for affordable housing that includes 54 buildings, including a clubhouse and wastewater treatment plant.  Property is identified as Pine Woods, Sharon and is located on Norwood Street and is situated in the Rural 1 Zoning District.

Town Counsel’s letter dated 1/24/07 read regarding boundary issue and site control.

 

Michael Intoccia presented the Board with new plans showing a reduction of units.  There a 104 condo’s ruffle 94 to 98 ft long.  The 104 condo/duplex units reduced to 52 single family 3 bedroom homes with 2 car garages.  There will be a no cut zone and 3 Everett St. homes have been eliminated.  The detention basin are now closer to the street.  This plan will reduce the traffic to the project by 40%.  The construction will be done in four phases.  Mr. Intoccia states he is willing to add a new plantings to the buffer zone if necessary.

 

Bob Shelmerdine stated at the last hearing the Board had a list of 11 issues and he has responded to them in a letter dated 1/18/07.

 

Paul Cussin, Delphia, Assoc. regarding the Mass. Housing Land Value Acquisitions Policy.  He has spoken with Attorney Vinacola who state that they are in compliance with the Mass. Housing Land Value Acquisition Policy.

 

Jonathan Witten, representing Mass Audubon has many issues site control, 2 acreage missing, boundary and land issues of 10 million.  Also, issues with trespassing

 

Paul Cussin responded stating that they hired and independent appraiser and they will stand by the appraisal until proven different.

 

John read a letter from Town Counsel stating that Mass. Housing has requested that the Applicant have a new appraisal and the Applicant will comply.

 

Mr. Witten presented Mark Violet a land surveyor from Schofield Brothers. He has reviewed the plans and he has analyzed boundary survey.  He will give brief review of the discrepancies.  Mr. Violet stated he obtained a copy of record plans from the Registry of Deeds and over laid them with the new plans showing the discrepancy of the property line.  Mr. Violet compiled this information from plans dated as follow: 1977, 1988 to 1990 and 1994.  The property was last surveyed in 1977. 

 

Mr. Witten has issues with the Applicant not having true site control.

 

John asked Mr. Witten how can they resolve the problem to the Audubon and the Towns satisfaction.  They would need to hire surveyor to put his or her stamp on the plans to comport with the testimony you heard this evening.

 

Mr. Intoccia responded stating that they have built everything within the stone wall and stayed away from the stone wall and left buffers, eliminated 3 houses, moved the detention basin forward and is donating an acre to the Conservation.  And still the abutters are not happy.  Mr. Intoccia has agreed to get a stamped plan by a land surveyor.

 

Bob Shelmerdine stating the boundaries are within the stone wall and they are building within the stone wall.

 

Paul Oliveria, Norwood St. asked the Board if they have seen the plans showing the number of bedrooms being proposed.  And the Town should choose the appraiser.  John responded they have not because the plans have just been presented.

 

Mr. Intoccia stated that the appraiser will be chosen from the Mass housing list.

 

Corey Bluestein, Pond View Circle, concern is with the number of children that this project will generate and that the schools are over crowded as they are now.  This project will make matters worse.

 

Mr. Barinson, 7 Huckleyberry Ln. is concerned with the water sewage, runoff and if the water table rise.

 

Board requested that the new plans be brought to the library for the public to view.

 

Mr. Witten wondered when the Board would see a new pro-forma to go along with the new plans presented this evening.

 

Sherm Allen, Moose Hill St., is concerned with the way the road is curving and where the road is being place.

 

The Board discussed the new appraisal and one was chosen.

 

Hearing continued until 3/14/07.

Next Zoning Board meeting is scheduled on February 14 at 8:00 p.m. in Town Hall.
